The FCC revoked the license of the 101.9 W270CS Gulfport MS from Amy Meredith Powell-Meredith Communications for failing to construct permanent installations at a licensed location prior to expiration. W270CS had applied for its cover license on July 20, 2021, which was granted on September 1, 2021 with the now standard condition that it must operate continuously for the first year unless it is proven to have not been built with temporary equipment.

On November 23, Meredith filed a silent STA for the translator for “technical” reasons without further details until later requested from FCC staff in which she stated that flooding from the hurricane Ida on August 30 damaged the transmitter, but it returned for a few days. later until it stops broadcasting on November 23 for additional unspecified technical operations.

The agency then sent a letter of inquiry in which Meredith admitted that the W270CS was built not on the site of the authorized tower, but 30 meters away on a nearby ham tower and RV park. . She maintained that the construction was “permanent” because the antenna was mounted on a shed fixed to the ground and was powered by a permanent electrical outlet shared with the RV paying the owner $300 to use the location for three months while intending to find another location after hurricane season. She stated that the translator operated from this site from July 19 to August 30, but then went silent and never returned contrary to her previous statement because Hurricane Ida damaged the transmitter, the tour and the motorhome, which led the owner of the motorhome to leave this place permanently. The translator would test operations on March 4 from an unidentified location, but determined it could not continue to operate without causing interference with Audacy’s 101.9 WLMG New Orleans.

Since the translator was never built in its approved location, the FCC considers its construction license to have expired without being built. The agency said “the constructed facilities were not authorized because PMC provided false information in the license application stating that it had completed construction at the authorized location.” The temporary nature of the facilities constituted a “separate and independent basis of action” which would also have resulted in the cancellation of the license for non-compliance with the license condition.

Radio Cleveland entered into a consent decree and agreed to a $6,000 civil penalty to resolve issues of an acknowledged unauthorized transfer of control following two unapproved share transfers.
